new legal requirements for ecommerce"},"content":{"rendered":"<h3>New rule for e-commerce operators<\/h3>\n<p>A European Union regulation requires all those who <strong>sell<\/strong> goods and services <strong>online<\/strong> and are <strong>based in Europe<\/strong> to include a link to the <strong>European Union&#8217;s web platform for online alternative dispute resolution<\/strong> (ODR) on their website.<\/p>\n<h2>What is ODR<\/h2>\n<p>ODR (&#8220;<em>online dispute resolution<\/em>&#8220;) is a process that will allow consumers residing in the European Union to <strong>file their own complaints.<br \/>\n<\/strong>Complaints are related to contracts entered into online (either for the purchase of goods or services) with companies based in the EU.<\/p>\n<h3>How it works<\/h3>\n<p>The forms for doing so involve conducting it <strong>exclusively online<\/strong> and will be essentially two:<\/p>\n<ul>\n<li>&#8220;<em>Blind Negotiation<\/em>&#8220;-there is a virtual mediation to resolve a dispute between a business and a consumer<\/li>\n<li>&#8220;Peer<em>Pressure<\/em>&#8220;-the disappointed consumer proposes a settlement of the dispute to the other party through a form that is posted on the ODR&#8217;s website, which intervenes, after the two parties have confronted each other and decided on a settlement.<\/li>\n<\/ul>\n<h3>Where does the legal obligation come from<\/h3>\n<p>The obligation to publish the link to the European Union&#8217;s ODR (&#8220;On Line Dispute Resolution&#8221;) platform is stipulated by the<em>Article 14 of EU Regulation no. 524\/2013<\/em>  and by the resolution on ODRs referred to in the  <em>Statutory Instrument no. 500\/2015<\/em>  and has been in effect since February 15, 2016.<\/p>\n<h3>What needs to be done<\/h3>\n<p>Every website owner who sells products or services online in Europe must include text explaining the possibility of availing themselves of the <strong>Online Dispute Resolution<\/strong> service by indicating the <a href=\"https:\/\/commission.europa.eu\/live-work-travel-eu\/consumer-rights-and-complaints\/resolve-your-consumer-complaint_it\" target=\"_blank\" rel=\"noopener\">link to the ODR platform<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>All those who sell goods and services online and are based in Europe will have to include a link to
